For what purpose do we process your personal data?

Your data will be processed for the purpose of processing requests for registration, revocation and waiver of representations in the electronic register of powers of attorney; managing requests for processing attended to for the purposes of registering representations, revocations or waivers; consulting the status and scope of registered powers of attorney and the documentation associated with the registration, revocation or waiver of powers of attorney; and generating electronic documents justifying the consultation in the register, for the purposes of their incorporation into the corresponding administrative files as accreditation of a representation.

How long will we keep your data?

Your data will be kept while the representation registered in the electronic register of powers of attorney is in force and once the representation has been terminated, for the time necessary to determine the possible responsibilities that may arise from the processing of the data. In addition, the periods of conservation and elimination of the data established by the National Commission for Access, Evaluation and Documentary Selection of Catalonia will apply.

What categories of data do we process?

  • Identification data (name, surname, middle name, DNI/NIF/NIE)
  • Contact details (email and/or mobile phone)

How did we obtain your data?

Your data has been provided by the person who has requested us to register a power of attorney in the electronic register of powers of attorney in which you have been designated as a representative or represented. You can check the identity of the requesting person by accessing www.representa.cat or the registration assistance office of any co-responsible person.

What is the legitimacy for the processing of your data?

The legal basis for the processing of your data is:

  • Compliance with a legal obligation applicable to the co-responsible for the processing (art. 6.1.c RGPD). Your data is processed in compliance with art. 6 of Law 39/2015, of October 1, on the common administrative procedure of public administrations.
  • Your consent (art.6.1.a RGPD). The email, mobile phone and first name data provided voluntarily are processed with the consent of the interested party. You have the right to withdraw this consent at any time, to do so you will need to deactivate the notifications from the citizen portal . The withdrawal of consent does not have retroactive effects. Therefore, it will not affect the validity of the previous treatment.

Obligation or not to provide data and consequences of not doing so

The mandatory personal data is necessary to manage the registration in the electronic register of powers of attorney. Consequently, if it is not provided, the representation cannot be managed.

If you do not provide us with your email or mobile phone details, you will not receive notifications about changes in the status of the registered representation. If you do not provide the given name, the administration will contact the interested person according to the name given at birth.

In no case will the management of the representation be affected by the fact that you do not provide your email, mobile phone or first name details or that you withdraw the consent previously granted.

To which recipients will your data be communicated?

The data may be communicated to other public administrations that hold power of attorney registers interconnected with the Representa electronic power of attorney register.

No international data transfers are planned.

What are your rights?

You have the right to obtain confirmation as to whether we are processing your data. You also have the right to access your personal data, as well as to request the rectification of inaccurate data or, where applicable, request its deletion, among other reasons, when the data is no longer necessary for the purposes for which it was collected.

In certain circumstances provided for in Article 18 of the General Data Protection Regulation, you may also request the limitation of the processing of your data. You also have the right to object to the processing of your data. In both cases, we will only retain the data for the purpose of exercising or defending claims.

How can you exercise your rights?

You can exercise your rights before any of the bodies jointly responsible for the processing, by electronic means or in person.

What avenues of complaint do you have?

If you consider that your rights have not been adequately met, you have the right to file a complaint with the Catalan Data Protection Authority.
